1. Acceptance of Terms
By accessing or using the Mobiroller platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms apply to all users, including visitors, registered users, and customers.
2. Description of Service
Mobiroller is an AI-powered no-code mobile application builder that allows users to create, publish, and manage mobile applications without writing code. The Service is provided on a subscription basis and may include features such as drag-and-drop builders, AI-assisted design, data tables, integrations, and app publishing tools.
3. Account Registration
To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at support@mobiroller.com if you suspect unauthorized access.
4. Acceptable Use
You may not use the Service to: (a) violate any applicable law or regulation; (b) distribute malware or harmful content; (c) infringe on the intellectual property rights of others; (d) transmit unsolicited commercial communications (spam); (e) attempt to gain unauthorized access to any part of the Service or its infrastructure; (f) create apps that promote hate speech, violence, or illegal activity. We reserve the right to suspend or terminate accounts that violate these policies.
5. Subscription and Billing
The Service is offered under free and paid subscription plans. Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may change pricing with 30 days' notice. Failure to pay may result in suspension of your account. You are responsible for all applicable taxes.
6. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Mobiroller and is protected by intellectual property laws. You retain all rights to the content and applications you create using the Service. By using the Service, you grant us a limited, non-exclusive license to host, store, and process your content solely to provide the Service.
7. User-Generated Content
You are solely responsible for the content you create, publish, or distribute using the Service. You represent that you own or have the necessary rights to all content you submit. We do not endorse user-generated content and are not liable for its accuracy or legality.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.
9. Limitation of Liability
To the maximum extent permitted by law, Mobiroller and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
10. Disclaimers
The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.
11. Termination
We may suspend or terminate your access to the Service at any time for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or a notice on the Service at least 14 days in advance. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.
